Terms and Conditions – Aarushi Treks and Tours Adventure Pvt. Ltd.

These booking terms and conditions form a legally binding agreement between Aarushi Treks and Tours Adventure Pvt. Ltd. (hereinafter referred to as “Aarushi Treks”) and you (the Client) for our services. Please read and understand these terms carefully before booking any trip with us.

1. Booking (Nepal Trips)

You can make a booking through our official website or via third-party websites.
All trip prices are quoted in USD. If you pay in another currency, the conversion rate will be based on the Nepal Rastra Bank (Nepal’s Central Bank) exchange rate on the day of payment.
To secure your booking, you must either complete the online booking process or submit a manual booking form (available upon request).
A 30% non-refundable deposit of the total trip cost is required at the time of booking.
For Nepal trips, the remaining balance must be settled either:
- During the pre-trip meeting upon your arrival in Nepal, or
- In advance by bank transfer or credit card payment.

2. Booking (Bhutan and Tibet Trips)

A deposit of 50% of the total trip cost is required at the time of booking. This deposit is non-refundable.
The remaining balance must be paid at least 20 days prior to departure by bank transfer or credit card.

3. Last-Minute Booking

Nepal trips: Accepted up to 10 days before departure, subject to availability. Full non-refundable payment is required.
Bhutan and Tibet trips: Accepted up to 20 days before departure, subject to availability. Full non-refundable payment is required.

4. Payment Methods (All Trips)

We offer the following payment options:

Direct Bank Transfer/Wire Transfer: Bank details will be provided upon request. Any transaction fees are the client’s responsibility.
Credit/Debit Card: We accept VISA, Mastercard, and American Express. A 4% processing fee applies.
Cash: We accept cash payments in USD, EUR, GBP, AUD, and CAD. Bills must be clean and undamaged. USD notes older than 2009 will not be accepted.

5. Cancellation and Refund Policy (Nepal Trips)

If you cancel 20 days or more before departure: We will retain the 30% non-refundable deposit. Any additional payments made will be refunded.
If you cancel less than 20 days before departure: 100% of the trip cost is non-refundable.

6. Cancellation and Refund Policy (Bhutan and Tibet Trips)

If you cancel 30 days or more before departure: We will retain the 50% non-refundable deposit. Any additional payments made will be refunded.
If you cancel less than 30 days before departure: 100% of the trip cost is non-refundable.

7. Rescheduling Your Trip

Nepal trips: You must notify us at least 20 days before departure to reschedule.
Bhutan and Tibet trips: You must notify us at least 30 days before departure.
A rescheduling fee of USD 200 per person (Nepal) and USD 500 per person (Bhutan/Tibet) will apply.
If transferring your trip to another person, it is the client’s responsibility to find a replacement traveler.

8. Incomplete Trip

No refunds will be provided for meals, accommodations, or services not used during the trip.
If the client commits any unlawful act during the trip and is asked to leave, Aarushi Treks will not be liable for any refunds.

9. Passports and Visas

Nepal: Passports must be valid for at least 6 months after return. Visas can be obtained at Kathmandu Airport upon arrival or through Nepalese embassies.
Bhutan and Tibet: Aarushi Treks will arrange all permits and visas. Related fees are included in the trip price.

10. Unforeseen Circumstances Disclaimer

Aarushi Treks cannot be held responsible for itinerary changes or cancellations due to:

Political unrest, natural disasters, pandemics, road closures, flight delays/cancellations, or government restrictions.
Any additional expenses resulting from these events are the client’s responsibility.
We strongly recommend comprehensive travel insurance.

11. Risk and Responsibilities

Adventure travel involves inherent risks such as injury, illness, death, or property damage. By booking with Aarushi Treks, you acknowledge and accept these risks. Aarushi Treks, its employees, and partners are not liable for any such incidents during your trip.

12. Travel Insurance

It is mandatory for all clients to have valid travel insurance covering:
- Medical emergencies and evacuation
- Trip cancellations and delays
- Lost baggage and equipment
- Natural disasters or unforeseen incidents

13. Flight Delays and Cancellations

Delays/cancellations in mountain regions (e.g., Lukla) are common.
Costs for alternative arrangements (e.g., helicopter evacuation) will be the client’s responsibility.

14. Trip Changes and Pricing

If a trip is altered or canceled due to unforeseen events, we will offer an alternative trip of equal value.
Price differences for rescheduled or upgraded trips must be covered by the client.
Prices may be revised at any time due to factors beyond our control.

15. Health and Fitness

Clients are responsible for ensuring their physical and mental fitness for the trip. Aarushi Treks may request a doctor’s clearance for high-altitude or challenging treks.

16. Children

Participants under 16 years must be accompanied by a parent or legal guardian.

17. Privacy

Aarushi Treks respects your privacy and will not share your personal information with third parties except where required by law or as necessary to operate the trip.

18. Publicity Rights

By participating in the trip, you grant Aarushi Treks permission to use any photographs or videos taken during the trip for promotional purposes without additional consent or compensation.

19. Complaints

If you have any issues during the trip, please notify our staff immediately so that we can resolve the matter quickly.

20. Participant Behavior

We reserve the right to remove any participant from a trip without refund if their behavior disrupts the group, causes harm, or involves illegal activities.

21. Governing Law

This agreement is governed by the laws of Nepal. Any disputes will be resolved exclusively by the courts of Kathmandu District Court, Patan High Court, or the Supreme Court of Nepal.
